Yes because either way it would be running lean. The timing marks are never perfect just close so a little off isn't a huge deal. Noticeably off is a different story. The piston down in the cylinder 1.5mm at tdc is not a problem, it is actually common, and you don't want it to protrude out the top of the cylinder.

I honestly think this section should be split up into 49cc and 125-200cc. It is hard to help people when most people don't post what size scoot they are talking about. For example, trying to link people to parts and such can't happen easily and jettin is completely different.

I wouldn't buy an HD scooter. It would probably be over priced, under powered and ridiculously expensive to modify.
