I think you have not eliminated the fuel pump as the problem...

Have you check to make sure your getting a good strong spark and make sure the spark plug cap is on tight and the other end too. About rtwo years ago my scooter was getting harder and harder to start, turned out to be a loose spark plug cap.

i got a good spark, and a new spark plug... its not the issue with starting its an issue with staying on once the engine gets to normal temp.... once the temp goes to the half way mark on the meter it starts to spudder, then it just shuts off.... sometimes will start right back up... other times wont start for a while

You need to check the coil/CDI when it stops working and won't start. If you can eliminate them as the cause it is likely fuel related. You need to eliminate parts by testing and not replacing them, it's a lot cheaper that way. Find a new mechanic he should know this...

DX scootnwinn is right, I'm leaning a little more on the ignition coil, because when they get hot, if it is bad it will start acting like that.

Many times it will not be the coil but a flakey ignition pickup. When they start to fracture and get microcracks in the phenolic they behave like this. You will think it is a fuel problem as the bike sputters and dies. The way it runs after a few minutes of cooling off make it then look like vapor lock or a bad gas tank vent however it is many times that $10/$15 ignition pickup mounted outside the flywheel soaking up heat from the engine block. By the time you take the bike apart it will have cooled enough to test out fine and even continue to test out fine if you run it with the covers removed however when you button it back up it gets hot and fails again. They can be very frustrating to verify while they are in the process of dying so that you won't be able to really tell until they are completely dead.
