Blocked carb vent line? Bad diaphragm? Have you been able to get the top off the carb yet?

No, I cant get the top off, somebody stripped the two screws out so bad, that It cant be taken apart. Is that where the Diaphragm is located?

oh sorry, I totally forgot.. It is a 50cc 2008 model chinese scoot, not sure of the name all it says is Magnum 50l on the side.. but it looks just like most of the VIP future champions with the 2 round headlights in the front fairing. I read somewhere on here where someone put a 24mm carb. on their 50 and it ran good.. so I dont know if it would be worth a shot or not.. im willing to try it, but its your carb. and im broke, so its up to you sir. But I wont hold it against you if you dont want to give up the carb on a maybe..

I had the same thing going on with my carb. I did end up getting a new one, but it doesnt hurt to try the intake manifold gasket, if its cracked or has a bad o ring it could alow air to enter along with the air it already pulls through the carb and it doesn't allow the proper ignition between the gas and spark. Just a cheap fix if that is the problem. My scoot however is still not working right, but found my intake gasket in 6 pieces replaced it and got it running better than before, even better after the new carb.

The screws on top of my carb were also stripped when I got my scooter. I bought a new carb on ebay for $24 and the carb has been working great. The choke is located on the back left corner of the carb. It should have a black plastic cap over it. Pull the cap off and you should see two screws holding a metal clip which is holding the choke on. Careful, those two screws may strip very easily when you attempt to remove them. After removing them and the metal clip gently pull the choke out. If it is stuck, it will not slid out of the carb easily. If it feels stuck, I would pull the choke out then put it back into the carb and then unplug its connector and start the bike. This is a photo I posted on another thread of two chokes of mine. The part that the needle comes out of is what could be stuck.
