The law in question is: cannot exceed 30 miles per hour on a level service
My question is: Does that mean, as long as I am under the legal speed limit of the road, I can go more than 30mph downhill?
I ask because the roads on my way to work are hilly. The speed limit is 55mph and I would like to be able to go that fast (or attempt to) going downhill without worrying about the MAJOR tickets involved. Like license, insurance, registration, etc
My scooter is 50cc, so I'm covered on the max cc. Just hoping others have input.

Not from North Carolina but I would think that going 25 over the legal limit would be asking for trouble on a 50cc. I know from what the law states that they allow some wiggle room for downhill but 25 extra mph would be pushing the envelope I would think.

That limitation is for the manufacturer to be able to sell the bikes in North Carolina as not requiring a motorcycle license.. The rider is still limited to 30 mph.

In SC they are pulling over people who exceed 30 MPH with a moped tag as to why my 2T is insured and has a MC tag

That limitation is for the manufacturer to be able to sell the bikes in North Carolina as not requiring a motorcycle license.. The rider is still limited to 30 mph. No... that law is there to say a 50cc scooter can not go over 30mph on a level surface. It's not manufacturer or dealer specific. It's user specific. Straight from the NC Department of Transportation site: Requirements for Use Must be age 16 or older to operate on NC highways or public vehicular areas. A motorcycle safety helmet is required by law when operating a moped on NC highways A moped cannot have a motor of more than 50 cubic cc, an external shifting device, or have the capability of exceeding 30 miles per hour on a level surface.Level surface being the part in question. It doesn't state "Can not have the capability of exceeding 30 mph" or "Restricted to 30mph."" It specifies "on a level surface."

Hey Folks, I finally found my way over from the "ScooterDawgs Proboards" . ..high ya'll
Concerning the Speed Limit you are allowed to ride on a Moped at, in North Carolina, it's 30 miles an hour uphill or downhill, ( this info comes from a NC Highway Patrol motorcycle Cop ). Do they enforce it, he said, "no"... except if the Moped Rider is riding in a dangerous fashion or exceeding the Posted Speed Limit, then you will get pulled over and ticketed just like a motorcycle or car. So basically it depends on how your riding. I personally have been riding Scooters/Mopeds (12) in the Charlotte area for over 20 years and trust me except for a couple of old Sachs' and a Motobecane they would all do over 30 mph. Even my 50cc Yamaha Riva would do 38mph, the 50cc Peterson would do 46mph, and nowadays with aftermarket CDi's and Coil's, changing out variator weighs, clutch springs and aftermarket exhaust pipes, every 50cc made can be modified to go at least 45 or 50mph. My last Scooter was a 2009 Jonway F-One 150cc and it was exactly the same size and look as the 50cc...so I pulled the 150cc decals off and cruised at 50 & 60mph when I was in a traffic situation that demanded it to keep me from getting ran over by the idiots that drive in my town. I drove that bike for 4 years until it got stolen on December 23rd, 2013 off of my front porch, in the rain, Locked up with a Master lock cable and with a cover over it, between 1AM & 7AM and the Police Station is in view of my front door !! I'm still looking for that one cause she was a runner..I also put a "Stroker Motor" in it too..
Ok sorry to go the long way around about telling you about the "speed limit " thing, but just be safe, cautious and obey the rules of the road and they won't mess with you.

Hey thanks PCBGY6, just telling it like I have seen it.
I do have a question for you and the Forum...
I just bought a 2012 TaoTao 150cc EVO, ( 1200km) runs perfect, looks brand new and runs great, I'm still breakin her in before I upgrade CDi and Coil, Variators, clutch springs, etc... (its the picture I have for an avatar ) "Burgundy Red", and I got the bike last Tuesday ( 6 days ago ) but last Saturday (while grillin out with my buddies and a couple of babes on the side of my apt complex ) this psyco beeotch who lives at our complex came out of her apt and walked by on the sidewalk where my scoot was parked, locked up and covered, and she pushed it over down the hill...yeah bad...she at first said she tripped on her flip flop...then said somebody keyed her car in our parking lot and she said she thought it was one of us ( 8 guys & 4 girls )...So you took it out on my new scooter ?!!! I've never been 20 ft from her car and don't even know the beeotches name. One guy saw her do it and she even fell down the hill doing it. He came down stairs and grabbed me and another guy and we lifted it up and I checked it out ( about wanting to yoke the girl out ) I found that its mostly cosmetic damage. ( paint scratched up ) I rode it around and its seem fine. But she just blew us off and said, " I don't know why your getting all blustered, its just a Scooter"...I almost slugged her.... I did make a Police report, but the officer said its hard to prove "intent" but by documenting what happened he said if anything else happens he can arrest her for "malicious intent to do damage". She left the complex before he got here and didn't come back for a day and now parked her car on the other side of the complex. Every body says she a crazy woman on some kind of drugs and she's a whore or a dominatrix or something, all I know is that if I see her ever get close to my Scooter again, I'm gonna......
Soooo.... I'm trying to find anyone who knows what the Color Code/who makes it/ of the Paint for a 2012 TaoTao 150cc EVO in the Burgundy Red color. The red is the only paint that got scruffed ( 3 different panels on the right side ) so I can have it repainted back to factory.
I mean I had it for like 4 days !! and now it went from perfect to Scarred !!!! Luckily there was a bush that kinda saved it from getting more damage.
I would appreciate anybodies help in finding the factory paint.

That part of the law is defining the limits on what can be called, sold or ridden as a moped. You have to read the entire sentence in context: "A moped cannot have a motor of more than 50 cubic cc, an external shifting device, or have the capability of exceeding 30 miles per hour on a level surface."The moped speed qualfication is based on when ridden on level ground and in this case restricts what you as a rider can claim falls under the Moped Regulation. Some police officers won't bother to enforce the regulation if your not being obnoxious however the law allows them to pull you over and potentially impound a bike for going over the 30 mph moped limit regardless of going uphill, downhill or on level ground. Modify the bike so that it can exceed 30 mph on level ground and it no longer falls under the moped classification and requires a motorcycle license.
