I'd be jumping up and down all over their insurance.
No way should be paying anything for this. Check your ribs for an imprint of their number plate.

Well, if it rides fine, just leave it as it is.. Who cares about a broken fender anyway? Less chance of being stolen that way!

yes some bent metal too. I did go to er by ambulance. Spoke to her ins company today. Claim in process.

Can't ride it with bent fork, hope you get a brand new one if you do id be interested in the seat and the cvt cover ;D

Take it to a welder. He might weld the frame. You can still ride with a bent fork; just as long as it's not wobbly, or the front wheel angled (if the front wheel is angled, you'll probably wear out the bearings.
Still, good enough to sell parts. Lots of people would probably want to buy parts of your scoot. Sell em cheaper as new parts, and you may be able to get 3/4 the price for a new scooter right there!

Thanks guys! Ive been looking at 50 cc scoots now that I have some knowledge about them and can pretty much pick one for a grand or so. Seems like my chinese scooter is about the onlo one with dual rear shocks ive seen from shopping around.

howdy and all the best wishes to you for a quick recovery. probably riding scoots is like flying where they informed me there were two kinds of pilot: those who have landed before extending landing gear, and those that will. there are scooterists who have been there, done that and those that will if they continue riding.
again all the best wishes and i hope i don't have nightmares thinking about it.
