was wondering how the laws on scooters were in different states. Here in NewMexico there really arnt any you dont have to have a tag,insurance,nothing the dmv told me as long as its 49cc and under treat it like a bycycle the 49cc and above have to reg,insurance,tag the whole works.also the 49cc must not go above 35mph or it has to be regestred so when out nwith the BBk have to be careful

Here in Puerto Rico All scooters must be registered and pass inspection. Yearly cost of $175.00 + $11.00 for inspection which also includes insurance for that year. Without this police will confiscate your scooter and fined $500.00 Must wear at all times DOT Helmet Gloves Boots Long Pants Eye protection after 6pm a reflector vest no loud exhaust system Helmets with face shields cannot have any type of tint on them. Must have a Motorcycle license to ride a scooter but rarely enforced

In SC it used to be a 49cc with pedals was a moped all other 49cc was a motorcycle . With the scooter explosion they laxed it to 49cc with 30 or 35 MPH limit . Well my 2T has a MC tag since I pass cars on the highway . When I had a moped tag I got hate from cagers thinking I was a DUI offender . With a MC tag I have not gotten any BS and with the MMG pipe its so loud I could not hear anything but wang yang yang yang .
I did get my TaoTao to where it was displaying over 60 MPH going down a slope one night , two cops pulled up beside me pointed and was laughing as I am a big guy and was on a small scooter going that fast . Some cops here are cool as I got warning ticket for going 72 MPH on my Echarm by a state trooper as he was curious about what kind of scooter went that fast .
If you have a tag , helmet and gloves you do not get bothered with unless your doing something odd . If no helmet , no muffler , wrecked panels and a 12 pack in a milk crate you will get hassled

What is stupid and will be fixed is one can not get a DUI on a moped but you can get arrested for walking while drunk . I met a guy on a 150 with moped tag that just went through a checkpoint and could not walk without staggering . I was so tempted to let the air out of his tires

Wisconsin All motor vechicles must be titled, registered, and plated including Mopeds and Scooters. The only break here is that 50cc machines you only need a drivers license to operate one.

In California the DMV told me that if it did not go over 30 miles per hour it did not need registration, but they also said that the CHP would still ticket me if they saw me on any road with it.
If it has pedals you can or at least could get a lifetime plate for a moped.

KS DMV told me if it's 125cc or over, it's a motorcycle. Thus, I drive a motorcycle. ;D
I don't know about the laws regarding small engines, since they don't apply to me anyways so don't matter to me. Sorry. I'm a big bad motorcycle gal, you know. HA!!

When the bikes pass DOT regs if they are over 125cc or a certain horse power they will get classified as a Highway Motorcycle. On my former Lance 150 the Federal DOT had it certified as a Highway Motorcycle so that is how the states had to view it.
Here in Florida if a bike can go over a set speed (I don't remember if it is 25 or 35) then you must wear a helmet unless you are an adult and carry the mandated amount of personal injury insurance required to ride without a helmet. Many insurances have clauses exempting personal injury coverage if you ride without a helmet so in Florida many if not most people who think thay can legally ride without one are not really exmpted from the helmet requirement.
DUI scooters are small sub 25mph (15/20mph) electrics with pedals. Anything faster than those requires a drivers license.

I lived in FL around miami and years ago you didnt have to have insurance only the tag they figgured you were going to get the worst of the deal if you wrecked

In California, our "scooters" are actually motorcycles, need a motorcycle registration and license plate, motorcycle insurance, and we need to wear a motorcycle helmet to ride on the streets. On a two wheel moped you need a Class M2 driver's license. On a two wheel motorcycle, even a 49cc, you need a Class M1 driver's license. A GoPed is legal on the streets. Orginally on Class-C only, corrected so you can ride on a Class-M license. In California, Trike or a motorcycle with a sidecar, requires a Class-C license, not a Class-M. In California we can have a Class-M motorcycle only license. If you have an only motorcycle license, you are not allowed to ride a trike or hack. Which matters only to lawyers and technicians who are picky. The DMV and the Cops don't care about the law. The lawyers have argued in court and the judges agreed that some of the laws may be ignored.

Whats the big deal? Often the 50 cc is a hazard to ther rest of us. .There is almost no 150 I would ride on the interstate anywhere.If I cannot keep with traffic, I believe in getting off the road. Particually while my friends and neighbosrs are trying to get to wokr on time.
Course I guess I am selfish that way.

Is a 50cc rider anymore of a hazard then the bicycle riders? In Missouri the law states I can ride my 50cc on any road that is not federally funded (IE interstates) I can ride them on state highways where the speed limit is 55mph even. Is it smart? Probably not, but it is legal. I must ride as far to the right and as safely as possible, but do not have to ride on the shoulder. If another vehicle passes me they must do so safely and leave ample distance, or they can be ticketed for careless and imprudent driving as well as wreck-less driving. If you operate any vehicle you must operate it as safe as possible manor. Just because the posted speed limit says you can drive a certain speed does not mean it is safe. It just means you cannot go any faster than the posted limit. Most people that have a license do not even know all the laws. They just think that other vehicles should not be on the road. I do not believe in just getting off the road. it is just as much my privilege as any other persons. Roy
