I dont know much about these motors other than they tend to be more powerful. What about maint and dependability?

don't get me wrong i'm a four stroke guy but the 2 stroke is capable of higher speeds but my speeds on my four strokes are quite good and i'm very happy

Like hank said, 4T is more reliable, environment friendly, and costing less in gasoline. It also doesn't require you to manually mix oil and fuel. 2T is less maintenance, no oil changes, better performance; and generally costs less than a 4stroke, eventhough most dealers sell them at the same price.
2 strokes may be illegal in your state (esp. if you're living in CA).
If you're limited to a 49cc, and it's legally allowed, you should go with a 2 stroke. If you can and want to ride bigger bikes, get a 4 stroke.
Usually a 2 stroke 49cc performs about the same as a 4 stroke 125cc.
4 stroke engines go up all the way to 650cc for scooters.

Depends on your riding.
Yup most not all two strokes are faster that a four stroke, and in some states you would be stuck with buying a used one if you want it.
If you get one a minarelli type is the one to get, they have lost of after market speed stuff available for them and it works well.
As far as sound goes I understand the newer ones sound better but in the old days they did sound like a weed eater or a chain saw because those are almost all 2 stroke motors.

My Honda Spree would zoom and I never touched it other than new forks and front tire from when I bought it wrecked . If you leave it stock and use good 2T oil you should be fine . Making mods and if the jetting is not 100 % you risk a soft seize .
2 stroke is often faster unless you count those stand up gopeds with a weedeater engine instead of a Minarelli or JOG style like mine .

26k miles? It'd be awesome to get that high! I was thinking most scoots won't get past 16k miles. Definitely worth buying then...
You got to think, that these scooters are about the same as the $150 lawnmowers from retail stores, they last forever, and are a good investment IMHO!
