So we have two 40ft containers that arrived at port about two weeks ago and they were being held for inspection by US Customs. They were looking for the 80cc bicycle engine kits and yup just got word today that they confiscated all 200 engines Our Chinese Supplier is suppose to give us a $15,000 credit for it because it was his fault he did not pack them according to our instructions. But yea it sucks

Dude, that sucks. Been down that road.
If you're nice, and it's simply a packaging issue (MIC stickers or whatever) Customs may let you re-package the engines in a Bonded Warehouse. They sometimes allow this if you haven't been a repeat offender. If they are looking for EPA certs on those engines though, you'll probably have to arrange to have the engines destroyed if you can't come up with the paperwork. This is the worst, we had to destroy a container of engines a couple of years ago. No, the Chinese company never refunded us either, and they normally don't even if they say they will. We ate that one, I hope that you won't have to.
spandi - Who is suing who? Unfortunately, as the importer of record, Scooter Elements is legally powerless to sue US Customs if the parts are indeed found to be in violation. Since it is Customs' job to inspect the inbound shipments however they see fit there is very little legal recourse. Scooter Elements can file for a re-assesment of the situation, but the parts will be warehoused at Scooter Elements' financial responsibility until a resolution is reached.
In short, dealing with US Customs can be a very trying experience, but it's that way by design.
I feel for you Walter, it's no fun.

Scooter Elements is a name i came up with a while back to change our online parts store we use to be called Scooter Parts III But i wanted something new and we did get a few people thinking we were partsforscooters.com i had to tell them no i am not. (can easily tell from both our websites They got the cool looking one lol

Yup it is US Customs job to inspect everything however they want. its their job to keep illegal stuff from entering the United States and here in Puerto Rico where drugs is such a huge problem they search everything. Currently our stuff is being held at a warehouse at our expense. if nothing happens then they will either destroy the stuff or send it back to the chinese supplier from what another person has told me. Our bicycle parts distributor had his engines all confiscated as well. Others manage to get them through like another store called America Scooters they were able to get the engines in and are charging up a storm for them. They retail here for about $180.00 or so and because they are in such high demand they are charging about $275.00+ for the kits.

Maybe they entrusted us to not violate the laws...or maybe their coffee and stories of last nights events was more important. Next time I will explain in better detail...or just avoid humor altogether..

You have me curious as to what was wrong with the engine kits they confiscated. Was it because the engines exceeded the 49cc limit for mopeds? I remember a while back the Feds and EPA had new restrictions on two stroke engines, but I forget when that went into effect though.
