Interesting link JR. But, the link is to an article from 2012, and, it looks like the Indiana Legislature has changed the law since then. This change of law may make JR's link meaningless, and it makes my brain hurt. So, I am out of this thread. I'm sure the law has indeed changed but I used this as only a reference as to the fact the Indiana Supreme Court had a issue with the license part of the law. But here is one unescapable fact by the OP's own words, he was stopped riding a scooter with no tags which is a violation of the new current law and since he was stopped for a valid moving violation the officer had the right to check things out and take further action if he deemed necessary by the laws of the State of Indiana. Now if the officer did charge him with other things then as stated it will be up to a court to decide what action to take. Also by the OP's own words his license was suspended and I can think of lot's or reasons people get their license suspended and further more ride a 50cc scooter because it is the only thing they can ride on a public highway other than a bicycle so we can assume this member has had a run-in with the law before if we read between the lines. Lastly this is a fact and you don't need a lawyer to know this, doesn't make a hoot that the DMV didn't know what to do to tag this member's scooter, he still road the scooter with no tags which is a violation of the law so one can use the "two wrongs make a right" theory here and even if the other charges are dropped I'm betting the no tag one will not be, that's a no brainer. The member willfully by his own admission rode the scooter with no tags. IMO this is one of the things that give the 50cc scooter a bad rap and it's a shame, I own a 50cc scooter along with others and I still enjoy riding it. JR

Then there are the guys putting 250 or 300cc Honda CB whatever engines in 50cc scooters and advertising them on Craigs List as "NO LICENSE REQUIRED". I saw two such adds in the past month.

Go to court pay the fees/fines and be done,,, much nicer and worth it to be clean and done with this kind of thing,,, OP,,, you're probably a nice person ,, but riding an untagged/ expired tag, unregistered bike with a suspended license is just asking for trouble,, and can lead to some hefty fines,, my son got a chickenshit bumper mounted towing ball obscuring the license plate ticket,,, he blew it off didn't pay the ticket,,, after a failure to appear warrant was issued he still drove,,, the court contacted the DMV and suspended his license,,, yep you guessed it,,, BINGO he won the prize,,, had a tail light bulb out and got pulled over,,, he was arrested his truck got impounded, his license suspended for a year,, truck impound fees over $700,,, fines and court fees,,, well over $3000,,, lost wages who knows,,, pain in my left nut every time he needs a ride,,, but don't ask me ask my wife cause I ain't playin,,, I didn't bail him out she did,,, all for a $120 ticket and laziness,,, now he has to pay one of his friends he works with to drive him around,,, nice,,,

When I lived in the Pensacola area back in the eighties, there was a local band called the Beach Monkeys that did a great cover of "I Fought The Law".

UP date the judge has ruled in this case there wont be a trail I was right!!! I should have been given a infraction a ticket and nothing more , lots of ppl said I should just pay, in fact Mike Torncey from speedway scoothers on 16st told me on the phone that not only would he not willing testifie. On my behalf (since he help write the new scooter law or had input to it) that in his exct words told me he would throw me under the bus ! Now there will be more court dates new ones as I sue to be made whole again ! my SR 50 still wont run after getting it out of impound and I just put it up for sale

Here in FL, the only "motorized" vehicle one can drive (ride?) in/on the street without a driver's license is an electric bicycle/scooter (must have pedals to be legal) with an electric motor of no more than 750 watts capable of no more than 20 MPH. And you have to be at least 16 years old. That's it! If it has a gas motor of any size or type, you must at least have a driver's license - if the vehicle is legal at all. One often sees these bicycles-with-a-gas-engine mounted on them - not legal on the roads in the State of FL - and I don't care how many licenses you have... 50 cc or less - driver's license. Greater than 50cc - motorcycle endorsement. No exemption yet (that I know of) for three wheeled vehicles... ... like the Scoot Coupe or the Polaris Slingshot...

The solution is obvious: make a 50cc just like any other motorcycle. Problem solved. In this case, the officer should have known the new law that was passed and he should have never went to jail-- problem solved. According to the OP, the BMV didn't even register his scoot when he went in, which is completely unacceptable. Sounds like the employee at the BMV needs better training-- problem solved.

Get over the Striking Back, Fighting the Law, I Won and such attitudes and just stop doing things to get your license suspended. The root cause here is not the law or the officer its the rider who chose to get his license suspended and took advantage of confusion at the DMV over the new regulations regarding registering his 50cc bike.
The SR50 is not a moped or bike that really should fall into the unlicensed class by any measure since it is a 50 mph capable bike which classifies it as requiring a motorcycle license in most States unless the dealer put a speed restricter on its direct injection system and the rider had not removed it. If the judge was aware of the special situation regarding a SR50 he likely would have had the same attitude as Speedway Scooters who are familiar with what an SR50 is capable of.

If he didn't derestrict the scoot then he was obeying the law pertaining to him being arrested for DWS, as long as it was under 35mph. Legally, he shouldn't be punished again because of the "root cause" He shouldn't be punished for that-- bottom line. I don't really think this is a "screw the police" situation, it's a situation that anyone should fight, IMO. I may need to read this thread again, but I don't recall him being pulled over for going over the 35mph law. Yeah he screwed up somehow originally to get a susp license, but a DWS will screw his situation up even more for no wrongdoing. Of, course if it's derestricted then I'd agree with you. Still though, even if it was derestricted and he stayed under the 35mph max, without proof he still shouldn't be charged-- not saying I agree with someone doing that and getting away with it, but that's how it works. I'm not sure how you can say he "took advantage of the BMV" when he stated he went twice to register it with no luck. Sure there may be other things he could've done to try and resolve that issue. I understand that the law is the law, but they don't have to drop the hammer down on everyone if they don't feel the need. Yeah he shouldn't have rode the scoot knowing that it needed registered, after the fact of the bmv failing to do so-- IMO they should drop that, too, if he can prove he tried twice to register it. The traffic court prob needs money though, lol, so that probably won't happen but it could.

They usually are 50 mph DiTech (Direct Injection) bikes requiring a motorcycle license that a dealer would have to restrict to make them lesser bikes. Sometimes we get too catty for our own good self justifying a way around the law and then get all bent out of shape when we get caught up in the tangled web we ourselves wove up. It sometimes depends on what was being asked for however difficulty in getting registered does not give one the right to ride unregistered on a public street. Pedal bicycle, walking, skating or bus pass is what the law abiding citizen chooses when they can't drive or ride a motorized vehicle themselves.

There's a method to the dmv/state law licensing and insurance madness thing,,,for one requiring insurance ,,,hit a Ferrari in the front fender ,,,ouch!!! raw primed fender in the box $4000,,,not painted or installed,,,drivers side mirror,,,just the case no internals ,,$2200,,,unpainted not installed,,,I don't even want to go into Lamborghini's ,, bentleys or rolls royce's,,,

I was not going over 25mph no speeding involved nothing was said about how fast my scooter might or might not go , I have had my sr 50 for 3 yrs and have always carried ins on it Indiana does not require this . Nor is a drivers lic the new law change says scooters now must be reisgerted , but still no drivers lic needed this is important ! for people like me and for scooter shops . In the states were no drivers lic are needed scooters are big sellers we can not let let a cop or prosecutor deiced to change the law because he doesn't like or agree with it.
