So I have been noticing a slight squeak when taking off sometimes over the past few weeks that seemed to go away after warming up. I thought it was the clutch but I may be wrong.
Now I am hearing a couple new weird noises one of them is like a "wahwahwahwahwah" kind of wobble/wah sound coming from the final gears. I poked my head all over and the noise is definately coming from between the clutch and the wheel so that means final gears.
The other new weird noise is a very loud like louder than the engine noise like the wahwahwah noise when at about 45mph+ it is the most concerning because it is stupidly loud like scarey loud. I believe it is also coming from the final gears but can't be sure until I meet a hollywood stunt cameraman to trail and record me (like that will ever happen haha).
There is oil in the final gears, I even went ahead and drained and refilled to make sure I had the right amount too and no change.

Took it apart, no visible damages or anything in there that shouldn't be.... Put it back together still same problem... The noise is definately coming from the final gears though, before I installed the clutch and wheel I twisted the shaft to spin it and it was very very hard to spin, but all the gears looked fine out o the case so what is going on here... Is there something else in the final gears besides the gears I should be worried about? The shaft is not bent, there doesn't seem to be any visible damages.... :/

The one thing you didn't mention.... the bearings. Lots of those in the transmission, and almost always the first thing to go south back there. Does it (the tranny) get excessively warm during an extended ride? When apart, did you notice any discoloration of the shaft, did you turn the bearings by hand checking for smooth operation.....no rough spots, sloppiness, or different feel than the others?
Your description sure sounds like a bearing to me.....

Well the sound became so loud I can't even hear anything else and it still definitely sounds like it's coming from within the final transmission gears.. The performance still doesn't seem to be suffering but the noise is not fun at all. Going to tear it apart and check everything again, I didn't check the bearings last time so that'll be my main focus this time.

If you are going that far get some bearings and install may save on down time.

So after fully removing everything from the transmission and getting it to start with just the crank and topend minus the transmission the noise was still there, so I have come to the conclusion that with over 40k miles this engine is done, period. The topend is brand new, the crank is all that's left. I also checked the flywheel and stator and everything was tight so it wasn't that either. It's definitely the crank, I mean it's got to be right?

Bearings. Crank depends on bearings also.

Bearings. Crank depends on bearings also. Well, I'm also noticing when it runs it pours oil through a tiny hole in the rear middle of the case in front of the wheel and behind the crank. I'm surprised though, the scooter never lost performance or stalled or anything when I had the engine in there, but did smell like burning oil right at the end before I removed it. I was able to ride it home the day it started acting up real bad, I had to drive about 40 miles and it made it home and coasted around 50 on the faster roads. It also kept working fine but the noise was too much I had to remove it.

It's possible (maybe not likely, but possible) that if you fix the leak and fill the crankcase again with oil the bearing will quiet down
