Thanks Kevin good to see some fight in you I am sure the prosecutor thinks the same way or hopes that I do as JR and ricardoguitars just lay down and pay . I happen to know the scooter laws and are in favor of them and I am not gonna let a cop change the scooter laws , he should have written me a ticket for not having my scooter registered that's what the BMV s and now the judge both said . So why didn't the prosecutor file the right charge??? he had ample time and my lawyer had tried to reason with him ? Because he see's ppl like JR and ricardoguitars too often . This case will have repercussions for any scooter rider with out a drivers Licen in Indiana and all the scooter shops that are so eager to tell you you don,t need a drivers Licen so buy my 49cc scooter!! no driver Licen needed . So I fight on next court date May 24 Whoa hang on here! I don't think myself or the other member you mentioned said anything about lay down and pay? it's your right as a American citizen to be heard by a COURT OF LAW whether you are innocent or guilty doesn't mater. I also said that the DMV was partially to blame. So I can easily blow a hole in that theory. Let's say for example the police pull you over for speeding and you open your window and are smoking dope, drugs are laying in the seat and a gun to go with it. So the officer is only going to give you a ticket and ignore the other issues? I don't think so. Same thing with a scooter, he pulls you over with no tags, asks for ID, you hand him a suspended drivers license, smell like you've been drinking, give him a cussing, is he just going to ignore the other things? In your case you were stopped for no tags and it's now up to a judge to decide your case. A police officer can charge you with any crime as long as he stops you for a valid reason, no tags was a valid reason and even though the DMV may be partially to blame , so are you IMO. You new the law said it had to be tagged, it doesn't matter that the DMV didn't know, that didn't give you the right to ride it anyway. I don't care anyway one way or another but maybe you don't know the law. Let me see if I understand the situation: 1.) "Mopeds" including scooters 50cc and under do not require a license to operate on the roadways. 2.) The law changed so that "mopeds" need to be registered and plated to operate on the roadways, the licensing requirement was not changed. 3.) You did not register or plate your 50cc scooter, you were stopped and you were arrested for not having a license, not, for failing to register. 4.) You are taking this case to trial because you were charged with the offense that you were not guilty of. Good luck, and listen to your attorney, not what someone tells you on the internet. Yep, it's a tough situation, and my position may be wrong. When the government fails to do it's job, citizens should not bear the burden, though we often do. I agree with that 100% and I would hope in this case the member can get the people at his DMV to stand up and say they dropped the ball and a good judge will see his good faith effort over this but the whole thing is hard to understand unless there are other factors we don't know about? I do see where he said "other" tickets with one being driving on a suspended license and one doesn't get a suspended license for a ordinary no ticket on a scooter nor does one go to jail and have their scooter impounded over it either? I would lean toward there is some unknown history in the past that has this driver in trouble with this officer and court? JR

If you went yo the BMV twice attempting to register your scooter, and you were turned away because they didn't know what to do, you should fight all the way! You did the right thing, and your lawyer should be able to prove you acted in good faith. There is a legal concept that requires knowledge and intent to break a law in order to be held liable, I believe your lawyer should be able to prove your good faith based on what you have posted here. I am one who has fought the law, and I won! Going to disagree with that and I'll tell you why? it's the simple thing that is always said and applies "ignorance is no excuse for the law" Now while I fully agree the DMV shoulders some of the responsibility for this members problems there were other options other than going ahead and riding "knowing" it was illegal to do so without tags. Could have asked for and called the State DMV asking for directions on how to properly tag a small scooter is one. I don't know Indiana law but in my state it's common for the DMV in each county to maybe not know how to do something with scooters so again they call the State DVM to get direction. Secondly after being told they didn't know how to do it a person could go to the State DVM and do it there, in my state you can do that, heck where I live you can live in one county and get tags in another if you have the proper paperwork? Lastly he could have went to the local police/sheriff's office and told them of his problem and they could have issued a temporary permit to ride the scooter or again you could have done that here with proof of ownership and insurance. So even though the DMV told him they didn't know how to do it didn't relieve him of his responsibility to obey the law and there was intent to break the law simply by riding it with no tags and knowing that he was indeed doing that. The DVM failed to help him but they didn't tell him it was legal to ride it still with no tags just because they failed and in fact they wouldn't have the authority to do so. JR

Regardless of what you or I think, there is a vast amount of people that do rely on the BBB for information, as I have said in the past, folks should not rely on one source when deciding to purchase from someone. I think we have debated this long enough and people will think about what has been said on both sides and draw their own conclusions. I thank you for your kind words I agree that a lot of people do give the BBB credit but I also think that people who belong to the BBB should have a problem with paying for their rating while others get it for nothing since credited and non-credited businesses are rated by the same criteria and people by looking a their system should second guess some of their policies and ideas. To me the BBB started out as a good idea and gets it's followers by a catchy name and we have lots of other ways to rate a businesses and as you said people should look at other sources to make up their mind. I have a problem with the BBB for reasons stated before, among them the known and reported BS way they unfairly rate people who do not belong to them and how they rate people with good ratings that they know nothing about.
So lets take the 17 points one at a time:
• The type of business
You sell and service scooters and they have a long list of companies that are bogus and that list is a no-brainer. So you are not on the list as a bogus type company but how many online scooter sales companies are just that bogus but their type of business is scooters?
• How long the business has been operating
Ok you've been in business now for 23 years and this means you are a great dealer? I know a little ATV/Scooter sales company 30 minutes from me that has ben selling and servicing these machines now for 2 years and they have people lined up to do business with them because they treat people right and have a awesome service department the same as you do so should their rating be lower than yours based on this thought?
• Whether the business has appropriate competency licensing
Now I love this one. How does a person get a license saying they are competent? Now some would say this means they are licensed to do business in the state that they are doing business in but to do business in most states including mine all one needs is a Federal Tax ID number which can be obtained for free online with a social security number. So how would this prove anything to help your BBB rating?
• Total volume of complaints filed against the business • The number of unanswered complaints • The number of unresolved complaints • The number of serious complaints • An overall complaint analysis • Number of complaints with a delayed resolution • Failure to address pattern of complaints
Lumped all of those into one category and it's as I said before this is due to what they have or have not heard from a consumer and how do we know that any higher rated business hasn't had any of those issues? Do you think for a minute that any business with a unhappy buyer would tell them to report them to the BBB or would common sense prevail for a business to want to stay in business by making the customer happy? I'll use the last example of the A+ rated seller that had one complaint that we are not sure what really happened and the BBB instead of contacting the business simply closed the case on the fact of "not hearing" back from the consumer! How did they arrive at an opinion of anything either way? They had the phone number of the business and the email of the consumer and I'm sure all of the consumers contact info but did they do a follow up to see if the business was on the up and up or the consumer was full of crap? You said they are a watch dog trying to help people?
• Government actions against the business • Any advertising issues found by BBB • The extent of background information available to BBB for evaluation
So is the BBB going to run a government report on all non-accredited businesses that have no complaints? So what about companies that go bankrupt re-establish themselves and go back in business? Would bankruptcy be considered a mark against their ranking? Who knows? Information available to them? Some info is private and not a matter of public record. I'm sure the BBB looks at every non member to see if they are doing what they advertise?
• The extent to which BBB is able to develop a clear understanding of the business
Hmmm? I wonder how many pencil pushers that work for the BBB know anything about scooter sales, service or can even ride one?
• Whether the business has honored any mediation/arbitration commitments
I'm sure every non member with 0 in this category deserves the higher rating when the BBB doesn't know if the business has honored anything?
• Whether the business has attained BBB Accredited Business status
Did they actually list this? Enough said.
• Whether the business has had its BBB Accreditation revoked
So I'm guessing if you get revoked you'll get a F on your report card?
Angie's List and the BBB is apples to oranges, Angie makes lists based upon customer reviews that customers do reviews on with the people they use. If a business applies to get on her list they agree to have themselves thouroughly checked out by Angie and the business receives reviews/ratings based upon their dealings with the consumer.
They are rated on a lot of different criterias like even how much they charge, did they complete the work in a timely matter etc, in fact Angie's List put's the BBB to shame and unlike the BBB if you screw up with Angie you don't get a bad rating you get REMOVED from her preferred list of vendors. Lastly people ask to be on her list and pay a fee, with the BBB you look up one day and there you are whether you asked or not, the BBB likes to stick their nose in people's business when they should mind their own. Ever wondered if you could ask to be OFF the BBB list?
It's been asked before what rating would you give the BBB?
I'll answer the question you asked about your rating. I said this before I know how you do business, I know how you treat people here, I have read about how you are a honest trustworthy person that I would do business with in a minute. I've talked to you on the phone(been awhile) and my thougths on you and your business are that you set high standards and have long before the BBB ever existed, still do today and will do tomorrow, that's all I need to know. If everyone treated people as you do we wouldn't need a BBB anything or a watchdog.

yelloscoot I didn't pay attention to the bulbs you used in your headlights so what are they? LED headlight bulbs? flickering indicates a loose wire or connection, did you check out the dimmer switch connecting plug well and all the grounds to the lights. The headlights and instrument lights are on the same circuit so they have the same problem. Does this scooter have a fuse box? if so they are notorious for bad connections, pull it out and check each fuse holder, people have been known to replace them with a better quality one. JR

Thanks JR! To your knowledge, that blank works on the "typical" Chinese scoot ignition? For mine - a 2008 Baccio VX150 - or for a Tao Tao Lancer 150? They have worked on 4 different scooters for me. Main thing is when the person cuts the key for them to take it slow and get the key aligned well in the key cutter. JR

floridagull your local Do It Best or Ace Hardware store can order this blank if they don't already have it on the rack. I ordered 10 of them and made spare keys for every one of my scooters, it's a ilco DC3 blank JR
