I was in an accident earlier today. traveling south on a 2 lane road approaching an intersection with cars going north in the turning lane turning west I had the green and as i got closer to the intersection one of the cars decides to make a turn so i let off the gas the car turns no big deal and the next one just waited till i got closer when there was nothing else i could do and pulled out a little bit in front of me and just stopped so i slammed on my brakes and braced for impact as soon as the scooter hit the van i vaulted over the handle bars and landed on the hood smashing into the windshield and breaking it with my shoulder. I wasnt going all that fast probably in the 20 something mph range so Im all right and the windshield absorbed most of the impact i just got a little scratch on my shoulder no big deal but I have no insurance and no proof of financial responsibility. It happened in a different state than i live in where the scooters registered and where im licensed. I know big mistake I should have had proof with me but im pretty sure im all good because the person who hit me knew it was their fault admitted it and was really nice about the whole thing the first thing on my list to do now is to get insurance or proof of financial responsibility. Next i would like to get some repairs done to my scooter or at least get some money so i could fix it myself the only thing I got from the police was a crash report information form that says me and my insurance company must complete an operators proof of insurance /crash report form within 10 days and if I need a copy of the crash report it will cost $10 and it should be available within 24 hrs from when it happened and that failure to return the report will result in suspension of my license and or registration which I dont think will happen unless it gets reported to my home state. So now Im looking or advice or suggestions on what to do now. Thanks in advance for any help.  |

YOu had no insurance? is it legal anywhere to have no insurance?

Since the driver of the van admitted fault then put in a claim against their insurance policy If that does not work then it is small claims court if they won't pay for the repairs personally. Personal injury may be no-fault however in most states the driver/rider that causes property damage can be held at fault and insurance companies can and will go after the at fault driver to recover their losses. Me I pay the $50 a year for the full coverage insurance that if my bike gets totalled gives me a new bike equal to the model I am currently riding regardless of what the replacement costs.

I assume the police report has his information, name, address, insurance co, ins policy ,ins co phone number etc etc.
The driver of the van should have already reported it to his ins co, and his ins co should be contacting you
(call up the guy and find out what he's done so far)
However, if not:
Call them up and give them all his and information, copy of the police report showing he admitted fault, etc etc.
They will have a bunch of questions for you also.
Admit nothing to them.
The van pulled into your path, and the police report should confirm that.
They should contact you in a day or so, send out an insurance adjustor to estimate the damage.
Within 30 days, you should receive payment for the damages to your scoot, and any medical expenses you had.
Option II
If the other party is willing to pay for damages,you'll need to get estimates on part replacement.
He can pay you for the parts and potentially any of your labour costs (what a mechanic would charge to do the work)
I recommend Option I (Ins route)
To protect you for any future liability and maybe even medical issues
Hitting a van, breaking the windshield can't be easy on a body.

And, you really should ge some insurance on that scoot.
The cost is minimul and it can only save you money in the long run.
Also, I believe it's the law.

Won't do much good now unless it can record your rides in the past... What he should have gotten was all the necessary paperwork to legally ride his scooter. If you have the required paper work submit it. Even if you don't make a claim against the drivers insurance (I bet the other guy already has and that they will contact you soon) then fix your scooter. Pretty straight forward. That van looks like they likely still had it fully covered due to the loan... I would in the mean time if I didn't have insurance go and buy some now and take that in they may not care that it has the wrong date on it... |

Police report will have the insurance info on it, Call them and file a claim. You need to go to the ER and be evaluated. I bet your gona be more sore tomorrow than today. If its not a no fault state then you having insurance is not an issue if the other person at fault and cited. Get some money. The other person would be foolish to settle with you out of pocket since they pay for insurance.

I'm not going to get into the legal part of your problem. I'm glad that you were not hurt to serious, but you should go to a hospital just to make sure. What kind of damage did the scooter sustain? Some photo's of the damage will help.
I just purchased a sony action cam just for this purpose. But I think a better option would be a dash cam. These are made just for this purpose. They are made for cars but could be adapted to a scooter. They are made to start recording when the power is turned on and stop recording when the ignition is turned off, so you don't have to remember to turn it on and off. They come with a variety of features such as built in gps, g-shock sensors, duel cameras, ect. They range in price from about 50 bucks and up depending on the quality and features. But if you go this rout do a lot of research and beware of where you buy from. There are a lot of cheap copy's.

 heres the scooter right after the accident after I pieced it together as best as I could on the spot  heres one of me with my bloody shoulder kind of a bad angle it was a selfie lol  heres my shoulder like 8 hrs later  the bloody shirt i was wearing  the rear part of the scooter on top by the trunk that space wasnt there before  this is probably the worst part of it the front  inside some broken pieces that hold the body panels together  more of the same different angle  rear brake handle bar lever the ball part at the tip broke off  side panel near the floor board got scratched after it went down  rear fender splash guard thing was rubbing because the body panel in the back was misaligned  cvt cover got scratched/chipped paint a little bit  here it is after duck tape and zip ties  I put it back together the best I could so I could still ride it the front part where the handle bars and top light are is jacked up a bit mostly because the parts where it clips and screws together broke i zip tied it back together and fitted together the best i could The duck tape on the outside front corners on top doesnt stay on all that well its holding for now I had to tape it up really good my main concern is the body panels staying together the scratches dont really bother me too much I could paint over them. As soon as I hit the van I thought it was gonna be much worse unridable but it actually went back together quite well my left side ached a little bit my leg right behind my left knee my elbow a little bit my front left thigh and of course my shoulder but nothing a little rest, ice or a good rub wouldnt cure |

First, you did right taking pics. IF his insurance fights the claim, you'll want those photos.
Second, go to your dr. Sure, you might feel fine. But you might not feel so fine in a few days. Wrenched injuries don't always show up right away. Plus again, if insurance fights it, you'll need that medical visit.
Third, go through insurance. And don't settle right away. Make sure you don't have injuries. Once you're sure you're fine, no lingering anythings, then settle. Except if I'm not mistaken you should be able to settle for the bike part, separate from any medical.
Fourth, really glad you weren't hurt worse.

Make some phone calls
Call the person that hit you
Tell them you will be calling their insurance co regarding a / the claim
If they want to settle outside insurance make sure they pay enough to fix or get a new one
Call their insurance and tell them their person insured caused an accident.
I'm not sure but this is what I would start doing
